Regents of the University of California v. Bakke

Ruling in Regents of the University of California v. Bakke, on June 28, 1978, the majority opinion declared, “The judgment below is affirmed insofar as it orders respondent’s admission to Davis and invalidates petitioner’s special admissions program, but is reversed insofar as it prohibits petitioner from taking race into account as a factor in its future admissions decisions.”

The question presented was:

“[W]hether Title VI of the Civil Rights Act of 1964 bars recipients of federal funds from giving preferential consideration to disadvantaged members of racial minorities as part of a program designed to enable such individuals to surmount the obstacles imposed by racial discrimination.”
